Terms & Conditions

These Terms & Conditions govern access to and use of skylar-brand.com and purchases made through the website. Please read them carefully before using the website or placing an order. By accessing the website, creating an account or placing an order, you agree to these terms to the extent permitted by applicable law. If you do not agree, do not use the website.

1. About Skylar and Contact Details

Skylar operates an online boutique selling men’s and women’s clothing.

Business address: 98, Gberigbe Road, Gberigbe, Ikorodu, Lagos, Nigeria. Telephone: +234 810 253 8812. Website: skylar-brand.com.

Before publication, Skylar should ensure that its full legal business name and any required registration details are clearly displayed on the website.

2. Definitions and Interpretation

“Skylar”, “we”, “us” and “our” refer to the business operating skylar-brand.com. “Customer”, “you” and “your” refer to a person accessing the website or purchasing products. “Products” means clothing and related goods offered for sale. “Website” means skylar-brand.com and its associated online shopping features.

Headings are included for convenience and do not affect interpretation. Where a provision conflicts with mandatory applicable law, the law will prevail and the remaining provisions will continue to apply to the extent possible.

3. Eligibility and Use of the Website

You may place an order only if you are legally capable of entering into a binding transaction under applicable law. If you are under the age of legal capacity, you must use the website with the involvement and permission of a parent or legal guardian who takes responsibility for the transaction.

You agree to use the website lawfully, provide accurate information and refrain from conduct that disrupts the website, compromises security, infringes rights or interferes with other users.

We may reasonably restrict or suspend access where necessary to protect the website, customers or business from fraud, abuse, unlawful conduct or security risks, subject to applicable law.

4. Accounts and Account Security

If account registration is available, you are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account, except where loss or misuse results from circumstances for which Skylar is legally responsible.

Notify Skylar promptly if you suspect unauthorised access or believe account information has been compromised. We may request information reasonably necessary to verify your identity or protect your account.

5. Product Listings, Images and Descriptions

We aim to display product descriptions, colours, sizes, materials, prices and other details accurately. Screens and device settings may cause colours to appear differently, and minor differences in presentation may occur. Such differences do not excuse a product that is materially different from its description or otherwise fails to meet legal requirements.

Product availability, sizes, colours and designs may change without notice. A product shown on the website is not guaranteed to be available until the order is accepted.

Customers should review available size guides, measurements, material descriptions and care instructions before purchasing. If information needed to make a decision is missing or unclear, contact us before ordering.

6. Prices, Taxes and Additional Charges

Prices will be displayed in the currency stated on the website. Applicable delivery charges and other mandatory fees should be disclosed before you submit the final order.

We take reasonable care to ensure pricing is accurate. If an obvious pricing or listing error occurs, we may contact you before dispatch to confirm whether you wish to proceed at the correct price or cancel the order. If payment has already been collected and the order cannot be fulfilled, an appropriate refund will be arranged in accordance with applicable law.

Promotional prices, discount codes, bundles and offers may be subject to stated eligibility conditions, validity periods, product exclusions and stock limits. Offers cannot be combined unless expressly stated.

7. Orders and Contract Formation

When you submit an order, you are making an offer to purchase the selected products on these terms. An automated acknowledgement confirms receipt only and does not necessarily constitute acceptance.

An order is accepted when Skylar confirms acceptance or begins fulfilment in a manner that clearly indicates acceptance. We may decline or cancel an order for a legitimate reason, including unavailability, payment failure, suspected fraud, a material listing error or inability to deliver to the supplied address.

If we cancel an order after payment has been taken, we will arrange a refund for the amount paid for the cancelled products and any associated charges that must be refunded under applicable law. We will communicate with you using the contact details provided.

8. Payment Processing

Payment must be made using the methods offered at checkout. Orders may remain unprocessed until payment is confirmed. You authorise the payment provider to process the transaction for the amount shown at checkout.

Payments may be handled by independent third-party providers subject to their own terms and privacy practices. Skylar does not intend to collect or store full payment-card details unless a secure and lawful process is specifically in place.

If a payment is declined, reversed or flagged for verification, we may pause fulfilment and contact you to resolve the issue. We will not request your full password or one-time authentication code by ordinary customer-service message.

9. Delivery and Risk

Delivery destinations, methods, fees and estimated timelines are set out in the Shipping Policy or displayed during checkout. Any delivery estimate is an estimate unless expressly stated as a guaranteed service.

You must provide a complete and accurate delivery address and reachable contact details. If delivery fails due to an incorrect address or recipient unavailability, the courier may reschedule or return the parcel. Any additional delivery charge will be handled in accordance with applicable law and disclosed where reasonably possible.

Delays may arise from courier capacity, weather, road conditions, public holidays, security restrictions or other events outside our reasonable control. We will take reasonable steps to provide available updates.

Responsibility for the goods during delivery and the remedies available for non-delivery or damaged goods will be determined in accordance with applicable law. Nothing in these terms transfers risks to you earlier than the law permits.

10. Inspection, Size and Fit

Please inspect products after delivery and contact us promptly if an item is missing, damaged, faulty or incorrect. The process for reporting and resolving such issues is described in the Returns & Refunds Policy.

Size guides and fit descriptions are provided as guidance. Fit can vary by garment cut, fabric and personal preference. Customers should review garment measurements where provided. This clause does not limit remedies where a product is faulty, materially misdescribed or otherwise does not conform to the order.

11. Returns, Exchanges, Cancellations and Refunds

Returns, exchanges, order cancellations and refunds are governed by the Returns & Refunds Policy, which should be read with these terms.

Please contact Skylar before sending any product back and follow the return instructions provided. Product condition, hygiene, tags, packaging and the reason for return may be relevant where lawful and clearly disclosed.

Nothing in these terms or the Returns & Refunds Policy excludes or limits consumer rights or remedies that cannot lawfully be excluded or limited.

12. Promotions, Gift Cards and Store Credit

Where offered, promotions, gift cards, vouchers and store credit are subject to the conditions stated at the time of issue or promotion. Expiry, redemption, transferability and exclusions must be clearly disclosed and will be applied subject to applicable law.

We may correct an error in a promotion or withdraw an offer prospectively where permitted by law, but will not use this clause to remove rights already accrued or to avoid obligations for an order already accepted.

13. Intellectual Property

Unless otherwise indicated, the Skylar name, logos, designs, website text, photographs, graphics and other website materials are owned by Skylar or used with permission and are protected by intellectual-property laws.

You may access and use website content for personal, non-commercial shopping purposes. You must not copy, republish, distribute, modify, sell or commercially exploit content without prior written permission, except where permitted by law.

14. Customer Reviews and Submitted Content

If the website permits reviews, photographs, comments or other submissions, you must ensure that your content is lawful, accurate to the best of your knowledge, relevant and does not infringe another person’s rights or disclose private information without permission.

By submitting content, you grant Skylar a non-exclusive, royalty-free permission to host, reproduce and display it for website operation and promotion, to the extent permitted by law. You retain ownership of your content. Do not submit content you do not have the right to share.

We may moderate or remove content that is unlawful, misleading, abusive, irrelevant, fraudulent or otherwise violates these terms, subject to applicable law.

15. Prohibited Conduct

You must not use the website for fraudulent orders, payment abuse, unauthorised access, scraping that disrupts operations, distribution of malware, impersonation, harassment, infringement of intellectual property or any unlawful purpose.

You must not interfere with website security, attempt to access restricted systems or introduce code that harms the website or its users.

16. Third-Party Services and Links

The website may link to or integrate services operated by third parties, including payment processors, delivery providers, social media platforms and analytics tools. Those providers may have their own terms and privacy policies.

Skylar is not responsible for independent third-party websites or services except to the extent responsibility cannot be excluded under applicable law or arises from Skylar’s own acts or omissions.

17. Privacy and Cookies

Our Privacy Policy explains how personal information is collected and used. Our Cookie Policy explains the use of cookies and similar technologies. These policies should be read alongside these terms.

Where consent is required for marketing or non-essential tracking technologies, it will be requested separately. You may exercise privacy rights available under applicable law using the contact details published on the website.

18. Website Availability and Changes

We aim to keep the website available and functional but do not guarantee uninterrupted access or that every feature will always be error-free. We may maintain, update or temporarily suspend parts of the website for operational, security or technical reasons.

We may update product listings, website features and these terms from time to time. The current terms will be published on the website with an updated effective date. Changes will not retrospectively remove rights already accrued or alter an accepted order except as permitted by law.

19. Warranties and Consumer Rights

Products are subject to any express warranty or guarantee stated on the relevant product page or supplied with the product. Any additional manufacturer warranty will be subject to its stated terms.

Nothing in these terms excludes statutory warranties, guarantees, consumer protections or remedies that apply under Nigerian law or other mandatory law applicable to the transaction.

20. Limitation of Liability

To the extent permitted by law, Skylar is not liable for indirect or consequential losses that were not reasonably foreseeable when the relevant transaction was entered into.

Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, defective or unsafe products where liability cannot lawfully be excluded, or any other liability that applicable law does not permit us to limit.

Where a limitation of liability is permitted, it applies only to the extent lawful and does not remove any mandatory right to a refund, replacement, repair or other remedy.

21. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural disasters, public emergencies, transport disruption, government restrictions, widespread network failure or interruption by a key service provider.

We will take reasonable steps to reduce the effects of such events and communicate material changes to affected orders. This clause does not remove a customer’s rights to cancel or obtain a refund where required by law.

22. Complaints and Dispute Resolution

If you have a complaint, please contact Skylar first with your order number and a clear description of the issue so we can try to resolve it directly.

Nothing in this clause prevents you from contacting a relevant consumer-protection authority, data-protection authority or other regulator, or from bringing a claim before a court or tribunal with lawful jurisdiction.

23. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Nigeria, subject to any mandatory consumer-protection rules that apply to the transaction. Disputes are subject to the jurisdiction of competent Nigerian courts, without limiting any non-waivable rights available to consumers.

24. General Legal Provisions

Severability: If any provision is found unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue to apply.

No waiver: A failure or delay to enforce a right does not waive that right.

Assignment: You may not transfer your rights or obligations under these terms without our consent where consent is legally required. Skylar may transfer business-related rights and obligations only where permitted by law and without reducing your statutory rights.

Entire agreement: These terms, together with the policies expressly incorporated into them and the information provided at checkout, form the agreement concerning website use and the relevant purchase, subject to mandatory law.

Third-party rights: Unless applicable law provides otherwise, a person who is not a party to the purchase contract does not acquire a right to enforce these terms.

Electronic communications: You agree that order confirmations, receipts and service messages may be provided electronically, subject to applicable law.
